
A New Jersey gay couple have won a legal battle over the custody of five year old twin girls, against a sister that acted as a surrogate.
The Star Ledger reports that Donald Robinson Hollingsworth and Sean Hollingsworth won a long fought legal battle over the custody of their daughters against Donald’s sister, Angela Robinson.
According to court records, Angela Robinson claims she struck a deal with her brother and his partner in 2005 to become surrogate, when she found herself with nowhere to live and moved from Texas to New Jersey to stay with her brother.
When her eggs were deemed unsuitable, a donor egg fertilised by Sean was implanted into Angela, meaning she was not genetically linked to the children.
A Hudson County Superior Court judge ruled that full custody be given to biological parent Sean Hollingsworth, while preserving visitation rights to Angela Robinson.
The attorney for the Hollingsworth’s, Karim Kaspar, said: “This decision is a victory for parents, particularly those in non traditional families who value diversity and inclusion and pass those values along to their children.”
