EXCLUSIVE: Three-hour HIV treatment trek forces council couple to move

A homeless couple have been forced to move from Argyll and Bute after a council housed them hours from a hospital equipped with the HIV facilities they need, PinkPaper.com can report.

A homeless couple have been forced to move from Argyll and Bute after a council housed them hours from a hospital equipped with the HIV facilities they need, PinkPaper.com can report.
 
Peter Munro and his partner Jay Turner, who are both HIV positive and require frequent life-saving treatment, take a ferry and two trains to Gartnavel Hospital in Glasgow - a journey lasting as long as three hours.

In September 2009, Turner's CD4 blood count dropped to a dangerous level of just 30. He was admitted to an intensive care unit and his condition has deteriorated since.

Now, the couple claim that their accommodation issues are aggravating the condition.

"My partner is in a critical condition, he uses a walking stick, becomes very breathless and can barely walk. The council have failed to appreciate this fact when they housed us on a remote island," Munro said.
 
"Hospital transport cannot always be provided due to our geographical location. Jay and myself have missed very important appointments and we become more isolated everyday."
 
In response, Argyll and Bute Council advised the couple to terminate their temporary tenancy contracts and seek accommodation from a different local authority. The council confirmed it will help facilitate a move to Brighton, as recommended by hospital consultants, where Munro has family to care for them.
 
But a spokeswoman for Argyll and Bute Council said there had been "no shortcomings" on their part.
 
She told us: "The Munro and Turner case has been handled professionally and sympathetically. Social workers have dedicated significant time and resource to find a solution in what has been a challenging case and we will continue to work with Mr Munro and Turner to facilitate their move to Brighton."
 
However, Munro claims that after providing 28 days notice to terminate their temporary tenancy - as requested by the council - the housing team has been unable to secure them accommodation in Brighton.
 
"Due to the fact that we handed in our notice, we gave our carpets away and our belongings are all packed but we strongly feel that the social work team within Argyll and Bute Council are simply not doing enough to help us find a home," he said.
 
A spokesman from Brighton and Hove Council said the demand for housing was "very competitive" in the South-East.
 
Jason Warriner, clinical director at the Terrance Higgins Trust, said: "Common sense dictates that travelling by ferry and then trains is detrimental to the treatment required for HIV patients.
 
"Choice is a right in terms of NHS facilities. Unfortunately in rural and remote areas of Scotland this right can not always be exercised."
 
He continued: "Where hospital transport isn't available, individuals should look to claim expenses for private travel when there are simply no other alternatives because of where you live, or where you have been housed."

The Council has seen copies from our doctors saying that we really need to be moved. These letters were shown to them at least a month ago.

The story is now all over Facebook and we are speaking to other media departments. My partner has now said he will not take his medication under protest at Argyll and Bute Council.

Hey, I'm posting again in response. You need to get legal with them as soon as possible. Get letters from your clinic to prove you've been missing hospital appointments and also a letter from your GP and Health visitor confirming just how unwell you both are and how this is having a detrimental effect on both of you. If they've not contacted Brighton and Hove then they've not been doing their job and all councils have a duty to safeguard vulnerable children and adults. If they've not been doing that then they're in deep trouble. I'll pop this story up on Facebook when I get home tonight, it's important that you guys get us all behind you. Just to add to last post. We emailed council with available properties in Brighton on Saturday. I spoke to the agent today the council has not been in contact with them.

There have been no compromises. We have been in tears on the telephone. We are at breaking point. We have both missed important appointments. We are sat here with no carpets we gave them away when we received the email dated 28th April and all our belongings are packed.

I poster before at 4:26pm. Hmm, it certainly does sound she's dodging your calls. It happens a lot in social service and housing circles, I've worked for both. Ok, if you have documentation then I would firstly send a letter to both the Chief Executive the social work manager who is in charge of your case, I would also go and get some legal aid and CC your legal representative in the letter too. Tell them that you'll be seeking legal assistance and will be liaising with LGBT officers and news sources around the country. Whatever you do keep all documentation, you may very well need it if this goes farther, lettters and emails sent and received. If they do not respond then send another one 14 days later following the same process as above. Can I ask? Have they offered a compromise? It is very hard for local authorites to move clients into another authority - but if they offered you accomodation elsewhere then they can argue they've been trying to assist you. Thank for advice. We tried calling the Area Manager yesterday and today and were advised she was busy or at lunch. Our social worker is now on the sick until the end of the month. Yes we have documentation.

Well after reading the article and reading your comments and I can only empathise with your position. Do you have documentation to say that social services will help facilitate a move to Brighton? Have you pushed this legally, go and seek legal advice because at the very least you deserve a response. Start a petition and pop it up on facebook - seriously, get everyone you know to sign it and pass it on. It can be sent to the Chief Executive.

The way we have been treated is appalling and we are now calling for the Operationa Manager and Chief Exec to resign. We have requested on over 40 occassions that the Chief Exec call us she has failed to do so.

To All reading this article, I am one of the people who this case concerns and I wish to comment on the comments by the council. The council have been less than sympathetic towards us infact the opposite. One of the social workers called his line manager from our home telephone on 16th March 2010 and told his line manager it was disgusting how we were being treated. The Chief Exec of Argyll and Bute Council has failed to respond to over 40 requests to call us. We advised the council on 16th March 2010 that we were too isolated this appears on our assesment. Our social worker had also advised us that his line manager had stopped him looking for properties on our behalf. We have advised the council on many occassions that we simply cannot cope and need to be moved. We had a letter dated on 28th April 2010 from the operations manager at Argyll and Bute council agreeing to facilitate the move and noting that we would end our tenancy.
